Navy SEALs Face Assault Charges for Capturing Most-Wanted Terrorist

Navy SEALs have secretly captured one of the most wanted terrorists in Iraq — the alleged mastermind of the murder and mutilation of four Blackwater USA security guards in Fallujah in 2004. And three of the SEALs who captured him are now facing criminal charges, sources told FoxNews.com. (http://www.foxnews.com/story/0,2933,576646,00.html)

Is this what we are going to see time and time again with the Obama Administration?

Sailors, Soldiers, Airmen, Marines, and Coasties brought up on charges of assault in a time of war? In a war where the enemy is by definition a spy, I can’t believe we are seeing our service members being brought up on charges of giving the terrorist who was allegedly responsible for the murder and mutilation of 4 Blackwater USA Security guards in Fallujah in 2004?

Maybe we should bring the people to trial who brought down flight 93 in that Pennsylvania field. Hell maybe we should bring the family members that they phoned from that flight up on accessory charges. You know those poor defenseless terrorists were killed sometime on that flight.

This is how ridiculous this has become. You capture a person of interest who fights for no country, under no flag, and wearing no identifying uniform. Under the Geneva Conventions, these people are to be summarily shot. Maybe the Obama Administration looks at the terrorists differently.

Perhaps Obama is aware that the terrorists do fight under a flag and and ideology, Islam. Maybe this is why Obama refused to call Hasan a terrorist with all the evidence before him. Obama is astounding when it comes to his lack of apathy for the tomb of the unknown soldier, when it comes to the 14 deaths at Fort Hood, when it comes to pretty much anything pertaining to the lives and the well being of the American service member.

Yet, his policies show that he’s going out of his way to protect the Islamic Terrorists.

Wouldn’t that be classified as Treason?

Webster’s Dictionary lists Treason as the following:

1 : the betrayal of a trust : treachery
2 : the offense of attempting by overt acts to overthrow the government of the state to which the offender owes allegiance or to kill or personally injure the sovereign or the sovereign’s family (http://www.merriam-webster.com/dictionary/treason)

Article 3 Section 3 of the Constitution of the United States of America defines Treason as follows:

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

“The Congress shall have power to declare the punishment of treason, but no attainder of treason shall work corruption of blood, or forfeiture except during the life of the person attainted.” (http://www.law.cornell.edu/constitution/constitution.articleiii.html)

Now, since the Congress aside from Michelle Bachman, Duncan Hunter, and perhaps Darrel Issa; don’t know or even follow the Constitution, I’m sure no charges will be brought forth.

I also find it interesting that Obama maybe the Commander in Chief but it is the Congress that sets the rules and regulations of the military. Article 1 Section 8 is very clear in this:

“To declare war, grant letters of marque and reprisal, and make rules concerning captures on land and water; “ “To make rules for the government and regulation of the land and naval forces; “ (http://www.law.cornell.edu/constitution/constitution.articlei.html)

How is it possible that the Obama Administration is able to change the rules for the UCMJ to try these service members under criminal assault charges?

How is it possible that a terrorist apprehended overseas and held overseas in a foreign nation, has what appears to be rights under the American Constitution?
